Career summary

Russell has acted for commercial and individual clients across a wide range of contentious and non-contentious matters since joining a City firm specialising in shipping and litigation in 2006.

Russell's principal practice areas are commercial litigation, arbitration and dry shipping matters.  Disputes in these areas have included: breach of contract and unjust enrichment claims, numerous issues arising out of the carriage of goods by sea, land and air, and international sales and distribution agreements.  Due to the nature of these disputes, Russell is experienced in taking instructions from domestic and international clients and liaising with insurers (including P&I Clubs) witnesses, experts and lawyers in other jurisdictions.

Russell has acted for clients in arbitrations under The Grain and Feed Trade Association (GAFTA), London Court of International Arbitration (LCIA), London Maritime Arbitrators Association (LMAA) and Singapore International Arbitration Centre (SIAC) Rules.

In addition to commercial litigation, arbitration and dry shipping matters, Russell has acted in claims for breach of duty in bailment and negligence, and claims under the Insolvency and Companies Acts for breaches of directors' duties, misfeasance and transactions at an undervalue.  He also has a continuing interest in travel law having advised and acted for cruise lines, operators and P&I Clubs for over 10 years in claims brought by passengers under the Athens Convention and/or the Package Travel Regulations.

Cases

  • Acting for Russian Claimant in LCIA Arbitration seeking damages of almost USD200 million for breaches of agreements relating to the division of international assets.
  • Acting for Indian Defendant Buyers in Commercial Court applications (ss68 and 69 Arbitration Act) made by Singaporean Claimant Sellers challenging a GAFTA Board of Appeal Award in the sum of USD1.6 million in client's favour.
  • Acting for Singaporean Defendant in the Queen's Bench Division of the High Court in a claim brought by two Claimants incorporated in the Marshall Islands, and client's counterclaim, arising out of alleged breaches of a USD18 million finance loan agreement.
